Defendant, Robert Larry Simpkins, appeals his conviction for possession of cocaine with intent to distribute and maintaining premises for the distribution of cocaine base.*fn1 On appeal, Simpkins raises three issues: (1) the evidence on the count of possession with intent to distribute was insufficient; (2) the trial court erred in not instructing the jury on the lesser included offense of possession of cocaine; and (3) the indictment was multiplicitous. Finding no merit to these claims of error, we affirm.
